Obtaining a domain name is, like registering a business name or devising a brand name, an important business move. However an exclusive right to use a particular domain name comes only with registration of a trade mark. There are usually no IP rights in the domain name. IP rights usually only reside in an associated trade mark. It is important to apply to register a trade mark as early as possible.
